How Does Graffiti Vandalism Affect Our Neighborhoods?

Cost of Removal Affects Everyone:

According to a 2002 report on graffiti crimes by the Department of Justice Office of Community Oriented Policing Services, “an estimated $12 billion a year is spent cleaning graffiti in the United States”.

Graffiti is Demoralizing to the Community:

Graffiti creates a sense of blight and neglect in a neighborhood and can contribute to a decline in property values and discourage economic development. Besides the sheer destructive nature of graffiti and the nuisance it causes property owners, it can also be related to hate crimes, drug activity or associated with gangs.

What is the City of Philadelphia Doing About Graffiti Vandalism?

For over 15 years the City’s Graffiti Abatement Team has been aggressively fighting back against graffiti vandalism, cleaning nearly 1 million properties and street fixtures since 1997. In fiscal year 2009 alone, over 115,000 properties and street fixtures were cleaned. The Paint Voucher Program was also created to provide homeowners, businesses and community groups with free graffiti removal supplies to enable them to clean their properties quickly. Both programs are designed to provide a rapid response to graffiti vandalism.

There are three ways to report graffiti vandalism and/or request clean up supplies:

What do the Philadelphia Anti-Graffiti Laws Say?

The penalty for an individual who commits graffiti vandalism, (Philadelphia Code 10-501(1) (Property—Damaging, Defacing and Interfering With) can be a fine of $300. The court may decide to order the offender to instead perform community service which may include “restoring the property to the condition it was in prior to its destruction, damage or defacement”. The court may also require the offender to provide restitution for the restoration of the property and also consider recommendations made by the victim. The law goes on to say that the parent, legal guardian or other legally responsible adult of any child under the age of eighteen (18) years who violates the code shall also be in violation.

Repeat Offenders:

The following excerpt taken from the Philadelphia Code describes the consequences committing multiple graffiti tags:

Any person who commits, on more than one occasion, an act of graffiti in violation of Section 10-501 (1) shall be guilty of a separate offense of Repeat Violation, and for each such Repeat Violation, shall be subject to a fine of three hundred ($300) dollars, or imprisonment for not more than ninety (90) days, or both. Each violation, after the first shall constitute a separate Repeat Violation offense” (Philadelphia Code 10-502(1)-Penalties).

Sale of Spray Paint Containers, Indelible Markers and Etching Acid:

Vendors must keep spray paint containers, indelible markers or etching acid “…in an enclosed device which is constructed to prevent removal of the merchandise except by the authorized attendants or is stored, out of sight, in such a way as to prevent free access to the merchandise by the public” (Philadelphia Code 9-618(3a).

“No person shall sell or otherwise transfer any spray paint container, or indelible marker or etching acid to a minor unless said minor is accompanied by a parent or legal guardian at the time of the purchase or transfer” (Philadelphia Code 9-618 (3b).

Penalties:

Any person who violates these laws can be subject to a fine or penalty “not less that fifty (50) dollars nor more than three hundred (300) dollars and/or imprisonment not exceeding ninety (90) days”. (Philadelphia Code 9-618 (5a).

What Can You Do?

1) Report it: As soon as graffiti appears in your neighborhood, report it by calling 311 or call the Neighborhood Services Division hotline at (215) 686-0000. You can also report graffiti online here. For the fastest response, please provide us with accurate information such as the exact address and zip code of the graffiti, the type of property and what removal method is preferred: paint/color or powerwash.

2) Remove it: The City also offers graffiti removal paint and supplies (brushes, roller handles, covers, etc.) to home owners, businesses and community groups throughout the city. Nothing frustrates a vandal more than to have their graffiti cleaned up immediately by the property owner. Request this easy to use form by calling 311 or 686-0000. 3) Don’t give up! It is discouraging to see graffiti slowly creep into the neighborhood or have it reappear on a wall that was just cleaned. But once the vandals know that a property is being quickly cleaned and maintained, they will stop targeting that property. Also know that the Graffiti Abatement Team and its services will continue to be available to you to fight back against graffiti as “re-hits” may occur.
