famecrazy
Just got a summons in the mail for "unsociable behaviour" dropped to my door. I have pretty much no recollection of the incident but it apparently involves me calling some dude I went to high school with a complete fuckwit, tipping a beer over his head and trying to kick a security guard in the balls while getting ejected. I have court in May. FUCK! Anyone who knows me, knows this is pretty out of character :D fuck these new victorian laws. if i get a criminal record my job is pretty much over. FUCK COPS. end rant. gasfacevictm
Did you get arrested? This might just be a civil case if the cops didn't come pick you up.
famecrazy
I was arrested at the time, but it was well over 6months ago, and i'd completely forgot about it.
gasfacevictm
Weird. I don't think you have much to worry about. Just keep your mouth shut. Get lawyer if necessary.
KM4RT
I was about to say the same thing as gas.... Still might be a just a civil thing. Are you being "charged" with unsociable behavior? Which court?
Swindle
you been to court before? id get a lawyer and do what they say. how is what you did even an issue though, i agree with you victoria is getting worse. police power searches? oh no no no

tango 24
damn you didn't even hit dude and you're still getting laid up with that? how long have you worked for your employer and can they help you out with a character reference in your defence? good luck homeslice
gasfacevictm
It will more than likely be a fine that you get. Summary offense type shit. Hopefully. I've gotten public drunkenness tickets before and ended up paying a fine. I dunno about those other ones though. You're in Canada aren't you? DUI's up there are felonies right? You guys are wacky. Good luck.
famecrazy
I'm from Australia not Canada. I've worked at this place for nearly 4 years. This will be my 3 court appearance 2nd since i turned 18. All had something to do with alcohol, and have done over 300 hours of community service and completed 2 responsible alcohol courses. maybe it's time to give up drinking. gasfacevictm
Every time I have ever been arrested it's been because of booze. I stick to beer mostly now and make sure I'm with people who can keep me entertained enough to not get stupid drunk and do stupid shit anymore. Defibrillator
I've got 4 charges: 1 - public drunkenness 2 - giving a false name to police 3 - unruly behavior 4 - ATTEMPTED ASSAULT ATTEMPTED ASSAULT? I TRIED TO ASSAULT SOMEONE BUT FAILED. jesus, i must have been drunk you're probably looking at some hefty fines man...i got picked up for punk in drublic last month, four hours in the nick and a $234 dollar fine. what the fuck is that, it used to be you do your 4 hours and thats it, none of this extra fine bullshit. and go see legal aid, it's not too bad of a service. if you don't have any other convictions get some reference letters and wear a bag of fruit to court and try and apply for a diversion, it's an automatic finding of guilt but with no conviction recorded (although will still show up on police checks etc)
famecrazy
already used my 1 diversion my man, so that's not an option. and it's less than a year since my last court appearance. FUUUUUU
KM4RT
Seek legal advice from a qualified professional. 1-3 I would think are all fines (at least here), on the spot or court determined. 4 might be worse, but probably only classified as a minor offense. tango 24
public drunkenness offences in VIC see if that shit helps
famecrazy
Penalties These offences carry the following penalties if you are convicted: * drunk in a public place: maximum of one penalty unit. * drunk and disorderly: o first offence – maximum of one penalty unit or three days prison o second or subsequent offence: five penalty units or one month prison * drunk and behaving in a riotous or disorderly manner – maximum of 10 penalty units or prison for two months. 2 months in jail because it's my second offense and they're claiming "attempted assault" is a disorderly manner? surely not. drumart
If its anything like the UK prosecution service, you could of killed the fuckwit, kicked the security guard in the face, and just for fun burnt the place to the ground, and you'd be walking free
famecrazy
yeah i'm 99.99999999% sure i will not go to jail, but i think i'll get a criminal record and a fuck load of fines. they're really clamping down on drunkards in victoria, so it's the wrong time to get caught up with these ridiculous charges. drumart
not good man. it isn't so bad having the record, but if you lost your job that sucks.
Swindle
you would definately want to get a lawyer. you should be able to beat off (nh) a few charges and end up with a fine and a CBO. i remember back in the old days when you get caught for doing something drunk underage they;d send you to the ropes course. nowadays they want to get all strict on people. we should embrace our convict heritage and get a little more lenient they are? damn, i just moved here really?
Mercer
Your only real choice if you need to keep your job is find a lawyer and drag this shit out indefinitely. The prosecutors will realize their about to drop $20,000 or more on some bullshit charges. They will eventually offer a plea deal that won't involve a record (I'm assuming you have no record yet). Just stay out of trouble till this shit is over.
