Student claims school spied on him via computer webcam

By Dan Hardy and Bonnie L. Cook

Inquirer Staff Writers

A Lower Merion family has set off a furor among students, parents, and civil liberties groups by alleging that Harriton High School officials used a webcam on a school-issued laptop to spy on their 15-year-old son at home.

In a lawsuit filed Tuesday in federal court, the family said the school's assistant principal had confronted their son, told him he had "engaged in improper behavior in [his] home, and cited as evidence a photograph from the webcam embedded in [his] personal laptop issued by the school district."

The suit contends the Lower Merion School District, one of the most prosperous and highest-achieving in the state, had the ability to turn on students' webcams and illegally invade their privacy.

"Fueled with state grants, the Lower Merion district issued laptops to all 2,300 high school students, starting last school year at Harriton and later at Lower Merion High, to promote more "engaged and active learning and enhanced student achievement,"

"Widener University law professor Stephen Henderson said using a laptop camera for home surveillance would violate wiretap laws, even if done to catch a thief."

WTF? So some dude breaks into my house, I catch him on video from the little camera in my mac book, but somehow I'd be the one who broke the law?

This guy has to be full of shit. Otherwise cams at banks, retail stores, etc. would be

deemed unconstitutional and any video evidence would be thrown out of court.

they caught the kid eating candy or someshit but accused him of selling drugs.idk how that happened but bottom line its not there place to spy on kids at home let alone discipline them for shit they did at HOME.fuck.people are stupid.

They never say what the kid was doing.

Also: this should violate some child pornography laws somewhere. I hope the parents in that district sue the fuck out of it.

Reminds me of this case

i think the difference is that your in public and not in your home where you expect some form of privacy.you know when you go to a bank or a store they have cameras and so its not being spied on.plus its not your store its theres.if they want to put cameras up in the store thats there business.not telling someone you put a camera in the computer they gave you and then use it to spy on you is an invasion of privacy.because its in your house and you expect a bit of privacy.especially when the principal wants to suspend the kid for shit he was doing at home. schools powers should stay in the school.not in the childs home.its overstepping boundaries in my view.but whatevs.

i was basing this off what was said on the news here.not from online.but regardless of what he got in trouble for he still got in trouble with the school for something he did in his own home.which doesnt make any sense.what gives them the right to spy on kids in their own home?

Right, reasonable expectation of privacy....but this applies to the homeowners, not a criminal.

Also, I understand that we have no reasonable expectation of privacy in a public place.

It's way overstepping. This is some bullshit.

I know, it sounds completely insane.

Maybe it's got something to do with the camera being "concealed"? Or maybe the law requires you to have to have one of those "You are under video surveillance" signs up?

I'm gonna have to look into this.

Wouldn't think so, but please let me know what you find.
