STUART -- The hyperactive little Jack Russell terrier named Kaylee would chase anything thrown her way.

And to the horror of several adults and children at the Kolinoski family July 4 picnic, she did exactly that with a powerful firecracker thrown into her yard.

No charges, however, were expected to be filed in the death of the dog after the firecracker exploded in her mouth, authorities said Tuesday.

"I lost a family member," Joseph P. Kolinoski, 26, wrote in a statement to a sheriff's deputy.

He said later in a phone interview that he was grateful no one else was hurt.

"It could have been a lot worse," he said. "We had a lot of kids out there."

Kolinoski said the family had been celebrating in their yard on the 1000 block of Southeast St. Lucie Boulevard when his wife's uncle drove by and threw the explosive about 5:30 p.m.

"He wasn't even invited," the dog's owner said. "She's a Jack Russell terrier. ... They're hyper dogs. They think everything's a toy."

Kolinoski said the 3-year-old, 8-pound dog was blown to pieces and was buried shortly after the incident.

After initially declining to press charges, according to the sheriff's report, Kolinoski said he now wants to bring criminal charges against the uncle, Stuart resident William George Kenny III.

Kenny, 46, could not be reached for comment.

Martin County sheriff's spokeswoman Sgt. Jenell Atlas said the firecracker was not illegal and there was no evidence of malice against the dog.

"They're not going to file charges because we don't believe there was any intent," Atlas said. "It was just one of those sad, we told you (so) ... with fireworks. This is what can happen."

She said the incident was deemed an accident.

That determination was little comfort to Kolinoski, who took the family out on his boat later that night to see the Stuart fireworks and get everyone's mind off the incident.

"It was unbelievable," he said.

His wife, Bianca Kolinoski, loved to show off Kaylee at dog events, he said.

"She's got the clothes for her. She just took her to a fashion show," he said.

:haha: :haha: :haha: :haha: :yuck: :haha:
