"no officer, there is no problem...I am an illustrator and was gathering research materials for a project i'm doing" "no sir, i am a photography student and i am working on my thesis, the theme is "urban decay"..." yadda yadda yadda... if you have a half decent explanation of what you were doing formulated before you do it, most of the time you won't get harassed, and usually if you sound like you know what you're talking about and they have no clue they'll just dismiss it as whatever and move along...COPS HATE DOING PAPERWORK i used to hate cops when i was younger, usually due to paranoia because i'd be driving around with 2 ounces of weed in my trunk, but as i got older, and more on the legal side of the law, i realized, these guys are just doing their job... cops are used to people buggin out on them...which makes them super defensive...so any hostility you show gives them a reason to fuck with you...flexing your knowledge of the law johnny cochrane style doesn't do shit...if you wanna protest your rights violated, be calm, AND ASK FOR THEIR NAME AND BADGE NUMBER... and no they don't have to read you your rights till you're actually in the station, interrogated and actually charged with something... not tryin to come off like an authority on cops, i avoid them whenever possible but i've had a few close calls and avoided getting bagged by treating them with respect even if i didn't mean it... "graffiti is art" lost the battle long ago with me. I see it as art.. but it is a completely different entity from sketching and painting canvas and sculpting. keep in mind no one is going to think it's art in court. try to pull "graffiti is art" in court and you'll get laughed at. become smarterer from this experience instead of wallowing in your hatred for this specific "oinker." You got off light they could have charged you with trespassing, resisting arrest,or any number of things. I ended up having to pay a lawyer to get the charges dismissed. I AM THE END Posted September 16, 2004 Share Posted September 16, 2004 Cops have the right to detain you under probable cause. he said he had a report of vandalism he catches you there, thats probable cause right there. unless he tells you your under arest specifically "your under arrest" then you dont need to be marandized. as far as holding you they held you to question you, you dont have to answer if you dont want remember probable cause, as far as them letting you go cuase of the judge he was right they had no reason to hold you and book you i dont see a lawsuit plus further more if it went trial or court they would want to know why you were there and all that whole nine yards so it might be a loose loose situation they might think your invloved and start watching you...
