Jackson, Timberlake Apologize for Flash

Feb 3, 8:48 AM EST

CBS, MTV, the NFL, Janet Jackson and Justin Timberlake all say they're sorry — but none of that is deterring the federal government from looking into the Super Bowl's too-revealing halftime show.

Federal Communications Commission chief Michael Powell on Monday promised an investigation into whether CBS violated decency laws, with potential fines of up to $27,500. If applied to each CBS station, the fine could reach into the millions.

"Like millions of Americans, my family and I gathered around the television for a celebration.

Instead, that celebration was tainted by a classless, crass and deplorable stunt," Powell said in a statement.

He added in interviews Tuesday that other aspects of the racy halftime show, which also featured such performers as Nelly and Kid Rock, also bothered him.

"I think everybody's focusing on the finale, but a lot of what we've heard in terms of complaints and the breath of the investigation is a little broader than just that incident," Powell said on ABC's "Good Morning America." "I personally was offended by the entire production."

The controversy erupted Sunday when Timberlake snatched off part of Jackson's bustier on stage, revealing a breast clad only in a sun-shaped "nipple shield" in front of some 89 million viewers.

"This was done completely without our knowledge," said Chris Ender, entertainment spokesman for CBS, which was deluged with angry calls. "It wasn't rehearsed. It wasn't discussed. It wasn't even hinted at. ... This is something we would have never approved. We are angry and embarrassed."

Jackson's spokeswoman, Jennifer Holiner, said a red lace garment was supposed to remain when Timberlake tore off the outer covering.

The NFL said it was "extremely disappointed." Several members of Congress, the Parents Television Council and the Traditional Values Coalition expressed outrage.

Even halftime producer and CBS corporate Viacom cousin MTV — the network that broadcast Madonna kissing Britney Spears at last August's MTV Awards — was contrite.

"Unrehearsed, unplanned, completely unintentional," said MTV.

Although Timberlake issued a statement shortly after the show apologizing and blaming the debacle on a "wardrobe malfunction," he didn't seem too sorry in comments to the syndicated show "Access Hollywood."

"Hey, man, we love giving you all something to talk about," he said, laughing.

Jackson's official Web site was bombarded with angry postings.

In a statement released Monday night, Jackson said it was a last-minute stunt that went awry.

"The decision to have a costume reveal at the end of my halftime show performance was made after final rehearsals. MTV was completely unaware of it," she said. "It was not my intention that it go as far as it did. I apologize to anyone offended — including the audience, MTV, CBS and the NFL."

Said the FCC's Powell on NBC's "Today": "I'm glad everybody is sorry. I'm sorry, too; it was a sorry incident. But if the standard were that you could do whatever you wanted to and if you apologized the next day that ends all further inquiry, we'd have a really poor enforcement program."

Holiner said she was not sure whether Jackson's medieval-looking nipple decoration was meant to be seen, but added that the singer does wear such jewelry.

But the display still raised questions such as: If it was an accident, why did a choreographer promise "shocking moments" in an interview with the Web site MTV.com prior to the show?

And how could it have been a coincidence when it was timed to the words of Timberlake's song "Rock Your Body" — "I'm gonna have you naked by the end of this song"?

MTV Networks Group President Judy McGrath says the shocker was supposed to be Timberlake's appearance — and not what he did afterward. McGrath was sitting in the audience and didn't see the flash, but said the pair "looked upset" afterward.

While she praised Jackson and Timberlake as artists, she said: "I don't appreciate someone who doesn't communicate what their plans are. I think it was a misguided move on their parts."

According to the FCC, non-cable TV channels cannot air "obscene" material at any time and cannot air "indecent" material between 6 a.m. and 10 p.m. The FCC defines obscene as describing sexual conduct "in a patently offensive way" and lacking "serious literary, artistic, political or scientific value." Indecent material is not as offensive but still contains references to sex or excretions.

Powell is an asshole. He's bringing a woman's breasts down to the level

of a public gangbang.

Here's the news, buddy: shielding your children from the wonders of the

human body forces them to be more curious, to rebel when they realize

the truth, and to start having sex at an earlier age.

I'm fucking appalled.

I watched a clip of this online... honestly, didn't see anything I wouldn't see watching MTV for five minutes. Or walking into a music store and flipping through the Hip-Hop section.

Americans need to wise up and laugh a little...

standing in your living room and exposing myself to your kids, and showing a breast on tv are completely different. especially when it comes at the end of what was i'm sure a very sexually charged performance, that contained language and mannerisms that would be just as potentially 'damaging' as seeing a boob.

i agree that being a parent and trying to raise your kids in a moral manner is a difficult challenge, but every single day kids are faced with far more lewd and vulgar displays than this, none of which happen in front of their parents, who could potentially give an explanation.

webs, when you were your daughters age, tell me you didnt already know about breasts.

not trying to hate on you, i know where you're coming from, i just think this is simply a drop in the bucket of sin we're already swimming in.

Yeah...right

Dude, you ever hear of breastfeeding? Boobies might be sexually sensitive, but they have no sexual function. I can show my hairy nipples anywhere I want to, but Janet's titties are offensive? Nah. Violence is offensive and that's what's on every channel. Most other countries have nudity on TV, and guess what...America still has more teenage pregnancies and sexual misinformation. Get over it, America.

in denmark, after midnight, everything turns to porn. no joke.

and as a society, they dont have half the social problems we do.

it's kind of like apples and oranges though. the problem isnt her breast, it's the moral decay of society in america. sex isnt immoral, and breasts arent immoral, but when you live in a place that tells you on one hand to be ashamed of who you are, and on the other, tells you if you arent that, you're worthless, that's where the problem arises.

it's like alcohol. all over europe, teen age kids are allowed to drink wine with dinner, yet they have a far, far lower instance of alcohol abuse than we do here.

i agree that things are fucked, but it's not janet's breast, it's a whole lot deeper than that.

you know seeking... it's not just europe.

think about your neighbour to the north for a second.

The highest drinking age of any province is 19 and some are 18.

You can bet that the people in Quebec take a much more european

approach to dealing with familty issues like if it's morally okay for

a teen to have a beer with dinner.

and this you may not have known.... but they allow nudity on most

Canadian Networks just after prime time. Shows like the Sopranos

air at 10pm on Network TV without any of the language or nudity cut.

Hell... at 11:00 on the weekends some networks switch to soft-core porn.

so what's my point?

The sway that the american bible belt has is way too powerful

for it's own good. With people like reverend... err... Jerry Fawell?

getting his panties in a bunch over a single boobie, you'll never

snap out of the 1950's puritan mindset. Well not untill that generation

is gone and the WWF and Jenna Generation comes into power.****

**** which isn't a good thing in my mind either.

"what's good for the goose is not necessarily good for the gander".

you couldnt start showing porn at 11pm, and allowing 18 year old kids to drink here because our society is not equipped to handle such burdens. we're complete morons here. in europe, after kids graduate high school, they often travel the world for a year.

in america, when they graduate high school, they go to community college or get high and work at pizza hut.

socially, we are fucked. allowing us the 'freedom' we claim to already have, would make our heads explode.

we dont want freedom, we want glass bongs that change color the more you smoke out of them.

i think any society making a drastic change in policy like that would not be able to handle it. but a generation later, it's normal. these things work themselves out over time. no one will give a shit about janet's boob in three weeks, everyone will forget. they might remember next year, when the half time show is disney characters laughing and hugging and everyone wonders why it's so boring, but besides that, it'll be gone faster than you can say "christianity is everything that is wrong with america."

look, the USA has always been a hot bed of sexual repression... there is no doubt that we are the most uptight western culture, though I think the Taliban and some of those Muslim countries beat us hands down...

Anyway, like Seeking said about Denmark, AFTER 12 or Kilo said about Canada AFTER 11... Now, to me, the actual time is irrelivant, it could be 4pm but the fact is, there is a set time when these countries have decided it's appropriate... even in their ultimate acceptance of sex.

As much as America needs to loosen up, the way to affect that change is not a prime time broadcast and certainly not the Super Bowl.

I'm not all about "won't SOMEBODY think of the children!" either... it was just a bit uncouth...

it's the classic band-aid debate: Fast or Slow

Sure there have been steps in making Amercan TV a little more

adult with shows like the Sopranos and with less justification, Wild On,

but those show are on cable stations at late hours. That's the slow approach.

Getting a tit in the superbowl is like yanking the band-aid off your nuts!

Fast, direct and painful to most everyone. However it can't be undone

and people will become a little more ready for the next time.

Maybe it's the direction that marketing is taking where sex sells but excessive

sex outsells the rest (britney, christina etc.) and there's no real way to

put this back in the box. The only thing worth discussing now is if and how

those parties involved will deal with the reactions to this stunt.

And how parents can prepare the kids for what's coming.

and as an aside...

when I was too young to be exposed to this kind of stuff,

I wasn't even allowed to watch TV show for grownups.

Sure many people think 'no way I'm missing the superbowl,

drop the toddlers on the floor' but that's not how it should be at all. Hell.... I wasn't allowed to watch 'Teen Wolf' because teens were playing some closet kissing game.
