Bill Would Put Internet Song Swappers in Jail

 

Internet users who allow others to copy songs from their hard drives could face prison time under legislation introduced by two Democratic lawmakers on Wednesday. The bill is the strongest attempt yet to deter the widespread online song copying that recording companies say has led to a decline in CD sales.

 

Sponsored by Michigan Rep. John Conyers and California Rep. Howard Berman, the bill would make it easier to slap criminal charges on Internet users who copy music, movies and other copyrighted files over "peer-to-peer" networks.

 

The recording industry has aggressively pursued Napster, Kazaa and other peer-to-peer networks in court and recently announced it planned to sue individual users as well.

 

In a series of hearings on Capitol Hill last spring, lawmakers condemned online song swapping and expressed concern the networks could spread computer viruses, create government security risks and allow children access to pornography.

 

Few online copyright violators have faced criminal charges so far. A New Jersey man pleaded guilty to distributing a digital copy of the movie "The Hulk" in federal court three weeks ago, but the Justice Department has not taken action against Internet users who offer millions of copies of songs each day.

 

The Conyers-Berman bill would operate under the assumption that each copyrighted work made available through a computer network was copied by others at least 10 times for a total retail value of $2,500. That would bump the activity from a misdemeanor to a felony, carrying a sentence of up to five years in jail.

 

It would also outlaw the practice of videotaping a movie in the theater, a favorite illicit method of copying movies.

 

"While existing laws have been useful in stemming this problem, they simply do not go far enough," said Conyers, the top Democrat on the House Judiciary Committee. The Recording Industry Association of America praised the bill and said it would help them fight illegal online copying.

 

One copyright expert said the bill paints online song-swapping with too broad a brush as much of that activity does not rise to a criminal level. "We don't think it should be the role of the FBI to treat all copyright infringement as criminal," said Mike Godwin, staff counsel at Public Sector, a nonprofit group that frequently disagrees with the RIAA.

 

A Conyers staffer said the bill had won the backing of many Democrats but Republicans had yet to endorse it. The staffer said backers hoped to discuss the bill at a hearing on Thursday and combine it next week with another sponsored by Texas Republican Rep. Lamar Smith, who chairs an intellectual-property subcommittee.

 

"Once we have the opportunity to analyze the bill language we will be able to determine how it affects our fight against piracy," a Smith spokesman said in an e-mail message.

Maybe the problem wouldn’t be such a big deal if they didn't charge $20 for a cd. I mean come on...it used to cost them what a dollar or two maybe to make a cd and they charged $15. Now it might cost them quarter or two and they are now charging $20. Greedy assholes.

if a cd was only 9 or 10 bucks, i'd buy it, but fuck spending 18 dollars on a cd that's gonna suck for the most part anyway.

not only do record labels need to quit being fucking greedy, but they also need to quit signing bands that fucking suck, and if bands expect to make it, they need to not fucking suck themselves.

i just don't think it will pass...take, for example, kazaa, they can't shut kazaa down because most of their servers are in other countries...soulseek? well, soulseek doesn't have any servers blasting out music, it's literally peer-2-peer...i dunno, fuck metallica, fuck dems and the g.o.p. fuck 'em all.

another fucking thing, is that i cant believe that this is even being fucking considered. jail time for exchanging songs? are you fucking kidding me? rapists get set free and people that trade music get sent to prison? i thought this was supposed to be a 'capitalist' society, i mean, thats how these companies are able to fucking rape everyone they come in contact with, yet they turn around and beg the government for legislation?! fuck you.

seriously, shit like this makes me so crabby, but i also realize how powerless we are against it....which makes me want to break shit and shoot people in places of authority even if they have nothing to do with anything.

it's not even 'pop' music thats really the problem. that stuff is usually pretty consistent in quality. i mean, if you like one n'sync song, your gonna like them all. it's shit like fucking 'puddle of mud' and 'nickleback'. these bands that front like they're rock, or indy, or god knows what, but really are just piece of shit with stick on eyes and scarves like mr. hankie.

that's the whole thing, seeking...those bands...nickelback, etc...they are all part of the pop factory, too. that's why they were signed...they had that "it" that "the kids just love"...

ok, here's a personal example...311

i used to love 311...i saw them in ATL alot when they just played hole in the wall clubs had the first two major label releases and some of their old demo's...good stuff...someone at the factory got ahold of them and they started changing around their third album. nick was being marketted to little higghschool girls and mtv picked up on that shit like it was a golden turd. 311 was forever ruined...i'm sure it went the same way with other bands...what was that one pop rock band that had that song about meth? holy shit, they had it bumpin' on mtv and the radio the whole time...it was catchy, but it was about doing a shit ton of crank...ha! they got one over on the pop factory...rambling again...damned hot and sour soup gave me a bad case of the shits and i'm trying not to think about it.

i remember in the early 90's being able to pick up a CD for like 11 bucks.

I don't see how they can justify charging twice as much now that the

technology has become much cheaper in creating Cds. I really like the

They have to catch me first. Using proxy servers makes finding the source of a request a rather mundane task. They may catch a few people, but they will never catch everyone.

And also, (i know this was already said but still...) If you want to start making money for the music youre making, then dont sign all these bands that sound the same and suck. If a band sucks, why would I want to buy their cd for 18 dollars...

 

speaking of which, who the hell has paid 18 dollars for a cd? My limit is 14. And it usually doesnt even have to come to that. It's all about mailorder ladies and gentleman.... and vinyl.

Maybe they need to realize they can't make money off selling CD's any more. Focus on making money through good concerts. Shit if you take away all the glamour money all that would be left is cats who love to play music because they are passionate about it. Get rid of people looking to get rich off of it and I bet you get rid of 95% of those bands that suck.

here's an idea, why doesnt the government get its fucking head out of its fucking ass for 2 minutes, realize they suck fucking cock for fun, and that they should possibly spend more time thinking about their record deficit due to insane military spending and the ever popular "war on terrorism" and how they are now looking to waste MORE time and money catching what i would imagine is mostly kids downloading music. but hey, i guess it really is the people who are against this right? the majority and all? since everyone loves paying insane prices for crap music. yeah, the governments doing a super job of representing the masses and not just some very rich people who suck.

Year 2000, USA fed Gov't spends 18.2 BILLION dollars on "The War Against Drugs" ... of course if they would have sold mary jane at an average tax rate of 6%.. based on average "user levels" they could have made 1.9 billion annually, instead of spending 18.2.
