This was in the newspaper the other day. It happened a few minutes away from my pad. If this dude catches a felony and has to go to prison for this shit this is a pussy ass tree hugging country.

SANTA FE SPRINGS -- County animal control officials are seeking felony charges against a Santa Fe Springs man who allegedly shot an opossum with arrows fired from a crossbow, then used a pipe to kill the animal after discovering it survived.

 

"To me, this is a clear-cut case of felonious animal cruelty," said Capt. Aaron Reyes, operations manager at the Southeast Area Animal Control Authority in Downey, which serves Santa Fe Springs, Pico Rivera, Downey and surrounding cities.

 

The opossum was shot at about 11 p.m. March 30, according to witnesses interviewed by SEACCA officials. The officials were notified of the incident by neighbors of the man, Reyes said.

 

One resident said he saw the man in his back yard, firing arrows at the opossum. That witness told SEACCA officials he thought the man had killed the animal.

 

However, when neighbors saw the opossum walking along a wall some seven hours after it was struck, several of them confronted the man. One resident took photographs of the wounded animal.

 

At that point, according to the witnesses, the man told his 17-year-old son to fetch a pipe, and the two of them killed the animal with blows to the head, according to witnesses' statements cited by Reyes.

 

The man has not been arrested, pending the filing of criminal charges, Reyes said. If a felony charge is filed against him, he will be notified of the criminal complaint and informed of his court date by mail, he said. Authorities have not released the man's name.

 

On Tuesday, Reyes said he presented SEACCA's investigative report -- which included witnesses' statements, the photographs and an admission from the man -- to the deputy district attorney at Whittier Court who is in charge of filing criminal cases.

 

However, Deputy District Attorney Deborah Cole-Hall said she was not yet ready to agree with animal control officials that a felony charge is warranted in the case.

 

"I thought it should be one thing and he (Reyes) thought it should be another," Cole-Hall said Friday. "I just want to run this by someone who knows more about it than I do. It's being reviewed by a supervisor."

 

Reyes said Cole-Hall suggested a misdemeanor charge be filed, but he insists it's a case of felony animal cruelty. The felony animal cruelty law requires authorities to prove a defendant "willfully and intentionally harmed, injured or killed" an animal, Reyes said.

 

A conviction for felony animal cruelty requires a prison sentence and a $20,000 fine.

 

"This certainly falls into that category," he said. "You look at that picture and you can almost see that animal walking away, thinking, 'I think I can make it.' He has that look."

 

He adding that he expects prosecutors to make a filing decision by early next week.

 

"The ball's in their court now," he said.

 

Whether the District Attorney's Office files a misdemeanor or a felony charge, Reyes said his office will insist that the man, if he's convicted, be required to undergo counseling as part of his sentence.

 

"We all know that there is a link there - people who commit violence against animals do often go on to commit violence against other people," said Reyes. "That's been pretty much established."

fuck that guy... killing animals just cause you think its funny is fucking wack. its not about tree hugging, its about respect for life in general. the guy thats gonna go out in his backyard and shoot an animal just for target practice, is the same one thats gonna spend the evening in hi living room, drunk off budweiser, preaching to his kids about the dangers of 'niggers' and 'spics'. fuck that guy. give him the chair.

dude wasn't killing the possum for the fuck of it. he killed it cause he didn't want it in his backyard fucking up the place. Those motherfuckers will fuck up a cat. The only reason he had to drop the pipe on it was cause it didn't die with the arrows. It's not like the guy wa getting off on watching it die a slow painful death. I'd rather him kill that possum than come home and see my cat all fucked up cause of some possum. It's legal for some redneck to travel 100 miles to get drunk and shoot some deer or turkeys but a man kills a fucking possum/giant rat in his backyard and he's gonna go to prison with fucking rapist's and shit.

that's so fucked up, killing an animal for anything other than food and self-defense is pretty cruel. i mean come on, think about it they're living things too. imagine you being that possum, doing whatever possums do and then out of nowhere you get loaded up with arrows by some redneck that's strung out on malt liquor and NASCAR. fuck that, and fuck cruelty towards animals. i've always had pets and could never even bring myself to hit one out of anger...much less kill one.

What picture are you talking about. None of these pictures are of the possum in the story these were all google searches.

 

FYI this happened in a working class Mexican-American community. It is almost all single family homes and warehouses/factory's. So no rednecks here.

Oh yeah opposums are scary looking but I'd never kill it. It's black voodoo eyes would scar me for the rest of my life. :spent:

I did have an encounter with one in a tree in my back yard. I tried to get it high by blowing smoke at it but it stared at me with those shiny glass eyes of his and I got creeped out and ran inside.

The only irritating thing is the inconsistencies with the laws about animal cruelty. What about hunting? In New Mexico, it's always open season on Mountain Lions! Just so one or two cows or sheep don't get eaten. Pretty stupid!

Maybe the guy should have called animal control or something if he wanted the thing out of his yard - not that they would have been any kinder to the poor thing. It's that red tape, protocol stuff...and the fact that neighbors thought he was torturing it, when maybe he was even trying to put it out of its misery.

 

The fucked up thing about humans is that we think we are number one over all other creatures. Oppossums, Rats, Racoons, Pigeons, Cats and Dogs have made the best of it by adapting to the urban environment, which is taking over the whole planet. Unfortunately, the first four aren't really 'cute' so they don't get taken in by humans.
