Metallica Sue Canadian Band over E, F Chords

 

MONTREAL - Metallica are taking legal action against independant Canadian rock band Unfaith over what they feel is unsanctioned usage of two chords the band has been using since 1982 : E and F.

 

"People are going to get on our case again for this, but try to see it from our point of view just once," stated Metallica's Lars Ulrich. "We're not saying we own those two chords, individually - that would be ridiculous. We're just saying that in that specific order, people have grown to associate E, F with our music."

 

Metallica filed a trademark infringement suit against the indie group at the US district court for central California on Monday. According to the drummer, the continued use of the two chords causes "confusion, deception and mistake in the minds of the public".

 

Metallica's lawyer, Jill Pietrini, told us that the band decided to take legal action only after first sending a letter of complaint to the Canadian band's singer/songwriter, Erik Ashley.

 

"We sent a demand letter and haven't reached a resolution, so we had to sue," she said. "They continue to shamelessly feature the two chords on their website song samples and we just can't have that."

 

Ashley, in the meantime, is still shocked by the entire story, and hasn't yet decided how the band will respond.

 

"I thought it was a prank at first," he told us. "Now I'm not sure what to think."

 

Ulrich states that he's not trying to prevent Unfaith from using the two chords, only that he feels Metallica should be credited for them whenever used, and is calling for 50% of all revenue generated from any song using them.

 

"It's nothing personal against them," he added. "We intend to enforce our rights with any band intending to use Metallica-branded chords in the future."

 

This marks the first time anything of this kind has ever been tried in court, and it will be interesting to see how things develop.

 

Metallica's website has issued an official statement on the suit here.

 

Unfaith's official website hasn't officially responded at print time.

Over the past few years Metallica has never shied away from using litigation to achieve their goals. In the past the band has taken on Napster, fans who swap their music online, a perfume company and even their own record label. Now it appears they have their legal guns aimed at an unsigned band out of Edmonton, Canada that is using the name Metallica without the California group’s permission.

The Edmonton Sun reported yesterday that attorney’s for the original Metallica sent the Edmonton group a threatening letter, ” promising serious action if the Alberta band doesn't change its name by Friday.”

 

The Edmonton Sun reprinted excerpts from the letter like the following, "Your use of METALLICA is particularly astonishing to the band, given that you have admitted in at least one interview that 'you know you are not allowed to use the name,' " wrote Metallica’s lawyer Jill M. Pietrini, in an e-mail sent to bass player and singer Blair William Piggott. “METALLICA could recover significant monetary damages and obtain an injunction against any further acts of infringement, both in the U.S. and in Canada.”

 

The Edmonton Sun report had a tongue in cheek flavor to it courtesy of Piggott who doesn’t seem to be taking the corporate Metallica’s threats that seriously. The Sun reported that “Piggott denies the name has any immediate causal connection to the Napster incidents, though agrees it's another way the band has lost connection to its fans.”

 

Piggott attempted to take advantage of the situation by passing along a CD of his group’s music to the members of the real Metallica and was told by Metallic’s attorney that it was against the group’s corporate policy to accept "unsolicited material."

 

Piggott responded, "'What are you talking about, you're suing us?' There's solicitation. They were once really in touch with the sexual frustration of the pimply high school kid.

 

"Now you can't even get them to listen to your music!"

 

Piggott further snubbed the California group by telling the Edmonton Sun that before he reaches a decision whether to drop the use of the Metallica name he would first consult with a friend in L.A. "who's had a lot of trouble with the media: Axl Rose. We'll take it from there.

 

"Second to Jesus, he's the voice of the next generation."

 

Rock 'n' Roll Pat, the guitarist for the Edmonton punk group explained why his band decided to use the Metallica name, "I think in most cases art reflects life, but in this instance, in this moment... life reflects art. That is clearly why we called ourselves

METALLICA.''

 

Will the band fan the flames even more and ignore Metallica’s threats? We will know in a couple of days.

A Metallica Fan with nothing better to do with $23 thousand dollars has won the privilege of joining Metallica for one day in the recording studio, according to a report by CMJ.

The day in the recording studio was a focus of a recent eBay auction from Metallica. The winning bidder came out on top with a bid of $23,200. The unnamed winner of the auction will have the opportunity to hang out with Metallica in the record studio as they work on their new studio album.

 

According to the CMJ report, the proceeds from the auction will go to the T.J. Martell Foundation, which according to their website uses donations to further “cutting-edge research that will advance the treatment and cures of leukemia, cancer and AIDS”.

 

Who’s next? Some of the people that Gene Simmons despises the most, Internet fans, are speculating that KISS is contemplating auctioning off a private concert with proceeds going to the grease painted rocker’s favorite charity, the “Gene Simmons Retirement Fund”, which is apparently is under funded, causing Gene and Paul to call off their retirement plans after bilking fans with their “farewell tour”.
