porque Posted June 10, 2002 Share Posted June 10, 2002 I have looked around on here and i haven't found anywhere where advice is given on what you can do if you get stopped by the police...so i'm gonna offer some... first off lets understand this hypethetical situation: you are out bombing, you have a typical messenger bag with paint in it: you are riding on a bike: you are seen by a police officer and he decides to stop you... the first thing he will ask is to look in your bag... unless he has actually observed you painting, he does not have the right to search your bag... he will say things like what do you have to hide?... respond by saying it is your right to privacy... this can save you in most cases from them actually getting anything on you and chargeing you... but also remember that you need to wear gloves to keep paint off your fingers b/c if you have red paint on your finger, and the alley you just came from has a fresh red tag in it, then they have probable cause to search you and you will be caught... If you are actualy seen painting you're pretty much fucked...my advice is run and hide and then hide longer ....i know this probably isn't the most coherent thing in the world so if anyone has any questions please ask...i have dealt with a few situations like the above and have adone a lot of research on the laws...plus i have lawyers in my family and they told me some intersting things too... I got stopped a while back, and I actually told the guy that I saw someone else doing the painting, and told him to cut the shit. If that was incriminating, there would be no point in in fourth amendment rights at all. Declining a search is in no way incriminating. It is your basic fucking right. It might actually be worth while to carry a plastic bag with ya so that you can put 'em away without soiling your pants, then again who goes painting in their sunday best. One other thing to mention is: you are running for your ass, they are running for their job, who wants to run faster...? porque Posted June 10, 2002 Author Share Posted June 10, 2002 refuseing to allow them to search you in no way incriminates you...simply ask to see the search warrant...when they can't produce one tell them you see no reason why you are being detained and walk away...most of the time if they push things further THEY are the ones breakig the law and anything that happens will be counted as inadmisable in court which means you're scott free... Another important thing to remember is that it is not against the law to carry paint around...it is only against the law to use that paint illegally...so unless they SEE you doing something you're usually ok. (u could just tell by looking at them)He got out of the car and started talking to them...The cop asked if he could look in the bag and the 2 guys said sure. There was atleast 10 cans in the bag along with some markers and stickers. The cop knew the guys were graffiti vandals but since the cop didnt see them painting he's well like im gonna have to let them go since we didnt actually catch them in the act. He checked there hands for paint and they were clean. Just as he was letting them go this bitch lady ran up to the police officer and said she saw thease boys putting up stickers on a sign. Now there isn't to much you can do to get away from that except, duck under a pine tree, there are heat monitors on those eyes in the skies and if your under a pine tree they cant see ya, trust me. I hit that wall almost every day with a throw to a peice to markers. But yea i was smart about it i never put a throw on the wall i was bombin that would be plain stupid. Got caught about to bomb then cops found i was driving a car that wasnt mine or my friends it was his dead grandfathers. So any how i had a can in my pocket and threw it when saw cops comming and my boy ditched his bag they took us by car back to the parking lot intarigated us for an hour i being responsibe toldthe truth. You would to if you were being screamed at by two cops i told the truth right he took me sat me down interigated my boys, and sent them back to the car, they came back and said ok you lookin at two years for the car thing with a graff charge and someshit, and he goes why should i let you off and i said 1 i told the truth and 2 i had nothing to hide. So he escprted me back to our town made me drive the car back and then i had to walk a mile and a half at 130 am. I got off from deep shit. THe moral of this story is honesty is the best policy, i told the truth and never got charged with any thing. BUt it is best to tell the truth because cops will set you up to lie. Daze One Million Posted June 12, 2002 Share Posted June 12, 2002 all you have to do is know how to lie, ive done it many a times, NEVER EVER tell the truth if you know they have nothing on you, they'll say they do, but thats bullshit, i had an incident where they were trying to charge me for some shit and i didnt admit to any of it, at all, not one bit, they said they had video and the head of the graffiti squad in our towns sworn statement that it was me, they said if i tell them, the charges will be minimal, but otherwise theyd basically fuck me over, i still denied everything, and what happened we sched a meeting so i can talk to the head graff cop and ask him how he "knows" i did anything. needless to say the cops never called me again, and it was over from there, just make sure you stay low for a while cuz cops were folowing me and my boys around for a long time Link to comment Share on other sites More sharing options...

They will ask you why you have paint so be able to come up with a good excuse...Lying is essential to getting away to further prove this point think about this... let's say the police have all kinds of evidence that i am selling drugs...they spend weeks and weeks getting proff and finally have enough for the magistrate to issue a search warrant for my house... upon busting in to my house they find: a prostitution service in my living room, an illegal casino in my bedroom, a conterfeit money lab in a clost and a full out cock fight in the basement... since their warrant is for drugs they can not arrest me for any of these other crimes, because before entering my residence they had no proof of such things... Being stopped on the streeet is the same way, if they search you looking for one thing and they find something else they can't do anything about it...esspecially if what they find is not in itself illegal (paint) but only implies by assumption an illegal activity...
