well talked to a laywer and her said sthat he delt with a somewhat similiar case and he said that we could use my girlfriends statement as heresay because she was mad and they there wasno way that they could say iwas drunk at the time i drove, since iw as out of the car for about 20 minutes before they arrived and found a empty beer bottle in the car, so he said we could plead that i just drank the beer sitting outside the car and then through it in, so i "technically" (according to what the lawyer wants to say) was drunk after i stopped drivin. so he says theres a good chance i can only get a drunk in public and/or disorderly conduct

i still want to know, if a written statement by her said she lied and that she was driving could the case be dismissed and only get charge with dwi? also what are consequences to a dwi in california?

thats what happened, but the keys werent out of the car, we and i was in the middle of the street. what the fuck i could still get wet and reckless but still man they didnt see me driving, so how could they give me dui? drunk in public would be better charge in my opinon
